1. Our Approach To Privacy

OzInDi Entertainment Network, including OzInDi Radio Australia, has been designed to allow audiences to watch and listen without surrendering their personal information.

We do not require audiences to create accounts, provide names or email addresses, establish viewing profiles or supply personal information to access our entertainment platforms.

OzInDi does not intentionally collect, store or access personal information about people using our:

- website;
- iOS application;
- Android application;
- Google TV or Android TV application;
- video-streaming services;
- OzInDi Radio Australia services; or
- other audience-facing platforms.

This policy explains our zero-data approach and the limited circumstances in which information may be voluntarily provided directly to us, such as when a creator or industry representative contacts us by email.

In this policy, “OzInDi”, “the Network”, “we”, “us” and “our” refer to OzInDi Entertainment Network and OzInDi Radio Australia.

 2. Information We Do Not Collect

OzInDi does not intentionally collect or maintain:

- audience names;
- audience email addresses;
- telephone numbers;
- postal addresses;
- dates of birth;
- user accounts or profiles;
- passwords;
- precise locations;
- contact lists;
- photographs stored on a user’s device;
- advertising identifiers;
- viewing histories;
- listening histories;
- search histories;
- saved tracks or favourites;
- playlists;
- content preferences;
- behavioural profiles;
- payment-card information;
- app activity connected to an identifiable person; or
- personal information for sale, advertising or data-broker purposes.

We do not build audience profiles or use personal information to determine what an individual person should watch or hear.

3. Saved tracks, favourites and app preferences

Features such as saved tracks, favourites, playback preferences and other personalised app settings are stored locally on the user’s device.

This locally stored information:

- is not transmitted to OzInDi;
- is not stored in an OzInDi user account;
- cannot be viewed or accessed by OzInDi;
- is not used by OzInDi for analytics, advertising or profiling; and
- may be removed if the user clears the application’s data or deletes the application.

Because this information remains on the device, OzInDi cannot restore locally saved tracks, favourites or preferences if the application is removed, the device is lost or the application’s local data is cleared.

Device backup services operated by Apple, Google or another device provider may include locally stored application data under that provider’s own settings and privacy policy. OzInDi does not control or access those backups.

4. No audience accounts

OzInDi audience platforms do not require users to create an account.

We do not maintain a central database of individual audience profiles, passwords, saved content or viewing preferences.

This means audiences can access available OzInDi content without providing identifying information directly to the Network.

5. No sale of personal information

OzInDi does not sell, rent, trade or commercially exchange personal information.

We do not provide audience information to:

- advertisers;
- data brokers;
- mailing-list providers;
- social-media platforms for advertising purposes; or
- third parties seeking to build behavioural or marketing profiles.

Because OzInDi does not collect audience profiles or viewing histories, we have no such information to sell or disclose.

6. No personalised advertising or tracking profiles

OzInDi does not use personal information to deliver personalised advertising.

We do not intentionally:

- track people across unrelated websites or applications;
- create advertising profiles;
- combine viewing activity with social-media profiles;
- sell behavioural information;
- use saved tracks or favourites for marketing; or
- use automated profiling to make decisions about individual audience members.

Any promotion appearing within an OzInDi service relates to OzInDi content, Australian creators, network programming, partners or activities and is not selected using an individual audience profile.

7. Website cookies and local storage

OzInDi does not intentionally use advertising cookies or tracking cookies to identify individual visitors.

Our website or applications may use limited local storage or essential technical functions where necessary to:

- operate a media player;
- remember a setting on the user’s device;
- maintain security;
- deliver requested content; or
- ensure the service functions correctly.

Information stored locally for these purposes is not used by OzInDi to create an identifiable audience profile.

Third-party components, hosting infrastructure or embedded media services may use their own essential technologies to provide requested content. Their handling of information is governed by their own privacy policies.

8. Technical infrastructure and service providers

Although OzInDi does not intentionally collect personal information from audiences, internet and application services cannot operate without technical infrastructure.

Infrastructure providers may temporarily process limited technical information required to deliver a service, such as:

- an IP address;
- device or browser type;
- requested content;
- connection time;
- playback information;
- security logs;
- crash information; or
- network-performance information.

This processing may occur automatically when a website, app, video or radio stream is requested.

Depending on the service, infrastructure providers may include:

- website-hosting providers;
- content-delivery networks;
- video-streaming providers such as Mux;
- internet-radio or audio-streaming providers;
- Apple;
- Google;
- app-store operators;
- crash-reporting services; and
- network-security providers.

OzInDi does not use this technical information to identify individual audience members or build personal viewing or listening profiles.

These providers operate their services under their own privacy policies and may process information independently of OzInDi. People should review the applicable provider policies for more information.

9. App stores and device platforms

OzInDi applications are available through services such as the Apple App Store and Google Play.

Apple, Google, device manufacturers and operating-system providers may independently collect information about:

- app downloads;
- installations;
- updates;
- device performance;
- crash reports;
- purchases or subscriptions;
- app-store accounts; or
- use of their platforms.

OzInDi does not control information collected independently by an app store, device manufacturer or operating-system provider.

Any information held by those providers is governed by their respective privacy policies and account settings.

10. Voluntary contact with OzInDi

The zero-data approach applying to audience use does not prevent a person from voluntarily contacting OzInDi.

If someone emails us, sends us a message or makes a professional enquiry, we will necessarily receive the information they choose to provide. This may include:

- their name;
- email address;
- telephone number;
- organisation;
- professional role;
- the contents of their message; and
- any attachments they provide.

We only use this information to:

- read and respond to the enquiry;
- continue the requested discussion;
- provide information;
- maintain a reasonable record of correspondence;
- manage a creator, industry or partnership relationship; or
- comply with applicable legal obligations.

We do not add a person to a promotional mailing list merely because they contacted us.

People should not send sensitive information unless it is genuinely necessary for their enquiry.

11. Creator and content submissions

Creators, filmmakers, musicians, performers, production companies and rights holders may voluntarily contact OzInDi about exhibiting or developing creative work.

Information supplied in connection with a creator enquiry may include:

- names and contact details;
- professional biographies and credits;
- project titles and descriptions;
- production and release dates;
- private screening links;
- artwork and promotional materials;
- cast and crew information;
- ownership and licensing details;
- music and other rights clearances;
- accessibility information;
- technical-delivery information;
- concepts, treatments or pitch materials; and
- correspondence concerning the project.

This information is not collected from ordinary audience members. It is provided voluntarily for professional assessment, communication or project administration.

We use creator-submission information only to:

- assess the project;
- determine whether it may be suitable for the Network;
- communicate with the submitting creator or representative;
- confirm rights and technical requirements;
- negotiate an exhibition or production arrangement;
- prepare selected content for release; or
- administer an agreed relationship.

Submitting material does not transfer ownership to OzInDi and does not guarantee selection, funding, production or exhibition.

12. Creator ownership and public information

Creators retain ownership of their work unless a separate written agreement expressly provides otherwise.

OzInDi will not intentionally publish private submission materials without permission or an appropriate written agreement.

If a project is selected, the creator may authorise us to publish information such as:

- creator names;
- professional biographies;
- cast and crew credits;
- project descriptions;
- production information;
- artwork;
- trailers or clips;
- interviews; and
- approved promotional material.

Once authorised information is published as part of a production or creator profile, it becomes publicly available.

Creators are responsible for ensuring that they have the necessary authority, rights and permissions to provide materials and information relating to other people.

13. Funding, industry and partnership enquiries

Filmmakers, creative teams, guilds, funding bodies, educators, production organisations and other industry representatives may voluntarily provide information when discussing:

- possible partnerships;
- development programs;
- funding rounds;
- original productions;
- professional-development opportunities;
- creator pathways;
- content exhibition; or
- other industry activities.

We use this information only to assess, develop, communicate about or administer the relevant opportunity.

Future funding or production rounds may have additional submission terms and privacy notices explaining how applications will be assessed and who may review them.

14. Disclosure of voluntarily supplied information

OzInDi does not disclose voluntarily supplied personal information except where reasonably necessary to:

- respond to the person’s request;
- assess a creator or industry proposal;
- administer an agreed project;
- obtain professional advice;
- operate secure email or business systems;
- work with an authorised assessor or confirmed project partner;
- comply with a contractual obligation;
- protect our legal rights; or
- comply with an Australian law, court order or lawful government request.

Where possible, we limit disclosure to the information reasonably required for the relevant purpose.

We do not disclose creator submissions to unrelated parties for advertising or data-broker purposes.

15. Overseas processing

OzInDi does not intentionally maintain an international audience-tracking database.

However, infrastructure and communication providers may operate systems outside Australia. This may include providers of:

- email services;
- website hosting;
- cloud storage;
- video and audio delivery;
- application distribution;
- security services; and
- content-delivery networks.

Technical information or information voluntarily sent to us may therefore be processed or stored in Australia, the United States or another country in which a provider maintains infrastructure.

Privacy laws in those countries may differ from Australian law.

Where Australian privacy law applies, OzInDi will take reasonable steps appropriate to the circumstances when using overseas service providers.

16. Information security

We take reasonable steps to protect information voluntarily provided to us from:

- misuse;
- interference;
- loss;
- unauthorised access;
- unauthorised modification; and
- unauthorised disclosure.

These steps may include:

- restricting access to authorised people;
- using protected email and storage services;
- maintaining software and security updates;
- using authentication controls;
- limiting unnecessary retention; and
- securely deleting information when it is no longer required.

No internet, email or electronic-storage system can be guaranteed to be completely secure.

Creators should use appropriate care when sharing confidential concepts, private screening links or access passwords.

17. Data retention

Because OzInDi does not maintain ordinary audience accounts, viewing histories or centralised favourites, we do not retain those categories of audience information.

Information voluntarily sent to us may be kept only for as long as reasonably necessary to:

- respond to an enquiry;
- assess a submission;
- administer a creator, industry or production relationship;
- maintain agreed licensing or production records;
- meet accounting, insurance or legal obligations;
- resolve a dispute; or
- protect legitimate legal interests.

When information is no longer reasonably required, we will take reasonable steps to delete, destroy or de-identify it, subject to legal, contractual, backup and archival requirements.

18. Data breaches

If OzInDi becomes aware of a suspected breach involving personal information held by us, we will investigate and take reasonable steps to contain and assess the incident.

Where the Notifiable Data Breaches scheme applies and a breach is likely to cause serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.

19. Access and correction

A person may ask whether OzInDi holds personal information they voluntarily provided.

They may also request access to that information or ask us to correct information that is inaccurate, incomplete, out of date, irrelevant or misleading.

We may need to verify the requester’s identity before providing access or making a correction.

Because saved tracks, favourites and app preferences remain locally on the user’s device, OzInDi cannot access, retrieve, correct or provide a copy of that locally stored information.

20. Deletion requests

A person may ask us to delete personal information they voluntarily provided.

We will delete or de-identify the information where reasonably possible.

We may need to retain limited information where it is:

- required by law;
- necessary to perform or enforce an agreement;
- part of a financial, licensing or production record;
- relevant to an existing dispute;
- contained temporarily in protected backups; or
- part of authorised public or archival production information.

Deleting an OzInDi app should remove locally stored app information from the device, subject to the device’s operating system and backup settings.

OzInDi cannot delete information independently retained by Apple, Google, a device provider or another third-party service. Requests concerning that information must be directed to the relevant provider.

21. Privacy complaints

A person who believes OzInDi has mishandled personal information may contact:

We will investigate and respond within a reasonable period.

22. External links and services

OzInDi platforms may link to external websites, app stores, social networks or third-party services.

Those services are governed by their own privacy policies. OzInDi is not responsible for the information-handling practices of an external service merely because we provide a link to it.

23. Changes to this policy

We may update this policy if:

- our services change;
- a new platform is introduced;
- our technical infrastructure changes;
- our information-handling practices change; or
- applicable legal requirements change.

The current policy will be published on the OzInDi Entertainment Network website with its effective date.

If we introduce a feature that collects personal information, we will update this policy and provide an appropriate notice before or when that collection begins.
